IX . The Right to Withdraw from Contract of Sale退貨
1. The Orderer has the right to withdraw from the contract of sale without stating the reason within 30 days of giving out the Goods on the day of the delivery. For this purpose, the Orderer should deliver Goods (together with the receipt or invoice) to the Tesco store where he/she made the purchase (the address of the Location shall be given on the till receipt).
2. Goods are subject to a return provided that they are in their original intact packaging, do not bear traces of being used and are complete so that the returned Goods are still sellable by the Seller. Goods protected by the manufacturer against opening may not be returned after removal of their packaging (e.g. foil) or protective seal.
1. 訂貨人有權(quán)在配送日發(fā)出貨物后30天內(nèi)無須說明理由要求退貨。要求退貨的訂貨方應(yīng)將商品(連同收據(jù)或發(fā)票)交付給他/她購買該等商品的Tesco門店(收據(jù)最上方注有相應(yīng)Tesco 門店的名稱和地址)。
2.商品只有在其原包裝未破損、沒有使用痕跡、且完整無缺的情況下才能退回,以不影響商品的重新銷售。除非有質(zhì)量問題,對(duì)于制造商采取防開啟保護(hù)措施的商品,在移除其包裝(如箔紙)或保護(hù)封口后,商品不得退回。
3. The right to withdraw from the contract of sale does not apply to:
1) Products purchased after 30 days from the date on the receipt or expired from its expiration date
2) Batteries and other consumable products
3) Products with package sealed off by the customers
3. 下列情形不得退貨:
1) 收貨已超過30日或有效期已到期的產(chǎn)品
2) 電池等其他消耗品
3) 商品的包裝或保護(hù)封口已被開啟
4. In the event of withdrawing from the contract of sale, the Seller will refund the price of the Goods to the Orderer. No delivery fee will be refunded (even if all the Goods in one order are returned by the Orderer) since the relevant delivery service has already been accepted by the Orderer on the delivery date.
5. The Orderer shall forthwith receive a refund of money for the returned Goods. When calculating the amount of the refund, the Price given on the till receipt shall apply.
6. The right to withdraw from the contract of sale does not exclude the Orderer's rights arising from the Seller's liability due to inconsistency of Goods with the contract of sale or from the manufacturer's guarantee.
4. 退貨后,賣方會(huì)將相應(yīng)的商品價(jià)款返還給訂貨人。由于訂貨人在配送日已接受賣方的配送服務(wù),賣方不會(huì)退還配送費(fèi) (即使訂貨人退回訂單中的全部商品)。
5. 賣方收到買方退貨商品后7天內(nèi)返還商品價(jià)款。
6. 退貨不影響訂貨人基于賣方商品違反合同要求或基于制造商的保證責(zé)任而獲得的權(quán)利。
X . Tesco Member Card Tesco 會(huì)員卡
1. The Orderer, who at the same time is a member of the Member card loyalty scheme run by he Seller, may during the registration process give the number of their Member card to collect points received for purchases made with the use of their Member card, on their individual Member card Account, in accordance with the principles of the scheme. When the registration process is completed, the Orderer may provide their Member card details via the Helpline. The Member card number given by the Orderer during the registration must be a valid Member card number. If a member card is deemed invalid at till then the Orderer is not applicable for Member card prices and other Member card benefits. The Member card is personal and can only be used by the Orderer who is a member of the Member card loyalty.
如果訂貨人是賣方所實(shí)施的忠實(shí)顧客獎(jiǎng)勵(lì)計(jì)劃會(huì)員卡的會(huì)員,可以在注冊(cè)時(shí)提供其會(huì)員卡卡號(hào),并根據(jù)該計(jì)劃的規(guī)定,使用因其會(huì)員卡購買商品而獲得的會(huì)員卡賬戶積分。注冊(cè)完成后,訂貨人亦可通過幫助熱線提供其會(huì)員卡的具體信息。訂貨人在注冊(cè)時(shí)提供的會(huì)員卡卡號(hào)必須是有效的會(huì)員卡卡號(hào)。如果會(huì)員卡無效,則訂貨人不能享受會(huì)員價(jià)及其它會(huì)員卡優(yōu)惠。會(huì)員卡是個(gè)人性質(zhì)的,只能由會(huì)員卡持卡人本人使用。
2. If the Orderer gave the number of their Member card, the Orderer will be entitled to specially discounted price and Member card points shall be added to their Member card account after the Order is run through the till and the Member card number is verified as valid in accordance with the regulations of the Member card scheme.
3. If the Orderer gave the number of their Member card (during the registration or later on via the Helpline pursuant to Point III.4 above), a relevant number of Member card points, corresponding to the number of points granted to the Orderer for the purchase of the returned Goods, shall be deducted from their Member card account in connection with the return of the Goods.
2. 如果訂貨人提供其會(huì)員卡號(hào)碼,訂貨人將可以享受會(huì)員專屬的特別折扣價(jià)格,會(huì)員卡積分將于訂單結(jié)算支付且會(huì)員卡號(hào)驗(yàn)證有效后添加到其會(huì)員卡賬戶。
3. 如果訂貨人提供了會(huì)員卡卡號(hào),發(fā)生退貨時(shí),訂貨人之前因購買商品而獲得的會(huì)員卡積分將被從訂貨人的會(huì)員卡賬戶中相應(yīng)扣除。
XI . Complaints投訴
1. The Orderer, prior to collection of Goods, may inspect them in the Customer Delivery Assistant's presence. The Seller recommends that the Orderer should not collect damaged Goods.
2. If the Goods are found inconsistent with the contract of purchase, after handing them over, the Orderer has the right to lodge a complaint to Tesco or Seller.
3. The Orderer should deliver Goods together with the proof of purchase to the Seller so that the complaint can be considered.
4. In the event of food products, a complaint about their inconsistency with the contract of sale may be considered by the Seller if it was lodged immediately after finding the Goods inconsistent with the contract of sale, however not later than 3 days after their delivery to the place specified by the Orderer.
1. 訂貨人在確認(rèn)收貨之前,可以當(dāng)著配送服務(wù)人員的面對(duì)商品進(jìn)行檢查核對(duì)。賣方建議訂貨人不要接受已破損的商品。
2. 如果訂貨人在收貨后發(fā)現(xiàn)商品不符合商品銷售合同的約定,則有權(quán)到賣方門店進(jìn)行投訴。
3. 提出投訴時(shí),訂貨人應(yīng)當(dāng)將相關(guān)商品和購買憑證提交給賣方。
4. 當(dāng)網(wǎng)上商品不符合商品銷售合同的約定時(shí),訂貨方應(yīng)盡快向賣方提出投訴。
5. The complaint shall be considered within 14 days of lodging it by the Orderer. The Orderer shall be informed by mail or by phone whether their complaint has been acknowledged or rejected.
6. In the event that the complaint has been acknowledged, the Orderer, after receiving information about the acknowledgement, shall receive a refund immediately after reporting in the Location.
7. The Seller shall abide by the laws and regulations as to the repair, replacement and return of goods in dealing with the complaints in this regard and the Orderer shall not be entitled to any damages or compensations in excess of those provided for in such laws and regulations unless otherwise consented by the Seller, the manufacturer.
5. 賣方應(yīng)當(dāng)在訂貨人提出投訴后的14日內(nèi)處理投訴。無論投訴是否被接受,都應(yīng)通過郵件或電話告知訂貨人。
6. 若投訴被接受,在收到有關(guān)投訴被接受的信息后,訂貨人可立即前往賣方門店領(lǐng)取退款。
7. 在處理上述投訴時(shí),賣方應(yīng)當(dāng)遵守有關(guān)維修、更換及退貨的法律法規(guī),訂貨人不得索要超出該類法律法規(guī)規(guī)定限額的賠償金或補(bǔ)償金,但賣方、制造商另行同意的除外。
XII . Final Provisions最終條款
1. The issues not resolved herein shall be governed by, including without limitation, the PRC Contract Law, the PRC Product Liability Law, the PRC General Principles of Civil Law and the PRC Civil Procedure Law.
2. Any disputes arising from the fulfillment of an Order, if the parties do not reach an amicable solutions, shall be considered by a competent court determined in accordance with provisions of the PRC law.
3. Tesco/Seller reserves the right to make changes to these Terms and Conditions. The changes may not violate the Orderer's rights arising from Orders raised before the changes become effective. All the changes to these Terms and Conditions must be published on the website. The changes to these Terms and Conditions shall come into force within 14 days of publishing them on the Website. Tesco/Seller shall inform the Orderer about such changes by a message sent electronically, including a reference to the text of the changed Terms and Conditions. If the Orderer does not accept the changes, he/she should inform the Seller about it by clicking the link "I do not accept changed to the Terms and Conditions", which shall be equivalent to the Orderer's request to remove their Account from the Website.
1. 本條款與細(xì)則未規(guī)定的事項(xiàng)應(yīng)根據(jù)相關(guān)法律解決,包括但不限于《中華人民共和國合同法》、《中華人民共和國產(chǎn)品責(zé)任法》、《中華人民共和國民法通則》和《中華人民共和國民事訴訟法》。
2. 對(duì)于任何由于訂單執(zhí)行而產(chǎn)生的爭議,如果各方無法友好解決,則應(yīng)根據(jù)中華人民共和國法律由具有管轄權(quán)的法院裁決。
3. Tesco/賣方有權(quán)變更本條款與細(xì)則的內(nèi)容。此類變更不影響訂貨人在變更生效前提交的訂單中的權(quán)利。任何對(duì)本條款與細(xì)則的變更將在網(wǎng)站上公布,變更應(yīng)在網(wǎng)站公布14日后生效。Tesco/賣方應(yīng)通過電子傳播媒介講本條款與細(xì)則的變更通知訂貨人,此通知應(yīng)該內(nèi)含發(fā)生變更的具體條款。如果訂貨人不接受上述變更,他/她應(yīng)點(diǎn)擊“我不接受對(duì)本條款與細(xì)則的變更”鏈接,訂貨人對(duì)變更的拒絕接受,同時(shí)會(huì)被視為其對(duì)注銷其賬戶的申請(qǐng)。
4. This Terms and Conditions have presented at the Website in both Chinese and English language versions. In case of any discrepancies between Chinese and English language version, the Chinese language version shall prevail.
本條款與細(xì)則以中英文兩種版本在網(wǎng)站上公布。若上述兩種版本之間存在差異,以中文版本為準(zhǔn)。
XIV. Disclaimer of Warranties and Limitation of Liability. 免責(zé)聲明與責(zé)任限制
Tesco/Seller's services and all information, content, materials, products (including software) and other services included on or otherwise made available to you through Tesco/Seller's Services are provided by Tesco/Seller on an "as is" and "as available" basis, unless otherwise specified in writing. Tesco/Seller makes no representations or warranties of any kind, express of implied, as to the operation of Tesco/Seller's services, or the information, content, materials, products (including software) or other services included on or otherwise made available to you through Tesco/Seller's services, unless otherwise specified in writing. You expressly agree that your use of Tesco/Seller's services is at your sole risk.
除非以書面形式另行注明,否則Tesco/賣方的服務(wù)和其中包含的或經(jīng)由Tesco/賣方的服務(wù)提供的所有信息、內(nèi)容、材料、產(chǎn)品(包括軟件)及其他服務(wù)均按“現(xiàn)狀”在“既有”基礎(chǔ)上提供。除非以書面形式另行注明,否則Tesco/賣方對(duì)其服務(wù)的開展、其中包含的或經(jīng)由Tesco/賣方的服務(wù)提供的信息、內(nèi)容、材料、產(chǎn)品(包括軟件)或其他服務(wù)不作任何種類的明示或暗示的陳述或保證。用戶/訂貨人明確同意,貴司將自行承擔(dān)使用Tesco/賣方的服務(wù)的風(fēng)險(xiǎn)。
To the full extent permissible by applicable law, Tesco/Seller disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. Tesco/Seller does not warrant that Tesco/Seller's services, information, content, materials, products (including software) or other services included on or otherwise made available to you through Tesco/Seller's services, Tesco/Seller's servers or electronic communications sent from Tesco/Seller are free of viruses or other harmful components. Tesco/Seller will not be liable for any damages of any kind arising from the use of any Tesco/Seller's service, or from any information, content, materials, products (including software) or other Services included on or otherwise made available to you through any of Tesco/Seller's service, including, but not limited to direct, indirect, incidental, punitive, and consequential damages, unless otherwise specified in writing.
